By accessing or using the FluxCascade platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Services.

2. Description of Services

FluxCascade provides a data integration platform that enables users to synchronize data between third-party applications and services. The Services include:

3. User Accounts

3.1 Account Registration

4. Subscriptions & Billing

4.1 Free and Paid Plans

FluxCascade offers both free and paid subscription plans. Features and usage limits vary by plan as described on our pricing page.

4.2 Billing

For paid plans, you agree to pay all fees in accordance with the billing terms in effect at the time. All fees are non-refundable except as expressly stated otherwise or as required by law.

4.3 Automatic Renewal

Paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings.

4.4 Price Changes

We may change our prices at any time. Price changes will be effective upon your next renewal. We will provide you with advance notice of any price increases.

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Services or related systems
• Interfere with or disrupt the integrity or performance of the Services
• Use the Services to transmit malware, viruses, or other harmful code
• Reverse engineer, decompile, or disassemble any part of the Services
• Use the Services to infringe upon the rights of others
• Resell or sublicense the Services without our written consent
• Use automated systems to access the Services in a manner that exceeds reasonable use

6.1 Ownership

You retain all rights to the data you submit to or process through the Services ("Customer Data"). We claim no ownership over your Customer Data.

6.2 License

You grant us a limited license to host, process, and transmit your Customer Data solely to provide the Services and as otherwise described in our Privacy Policy.

6.3 Responsibility

You are solely responsible for your Customer Data, including its accuracy, quality, and legality. You represent that you have all necessary rights to submit Customer Data to the Services.

6.4 Data Processing

Our processing of Customer Data is governed by our Privacy Policy and, where applicable, our Data Processing Agreement.

7. Intellectual Property

The Services, including all content, features, and functionality, are owned by FluxCascade and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Services without our prior written consent.

7.2 Feedback

If you provide us with feedback or suggestions regarding the Services, you grant us the right to use that feedback without any restriction or compensation to you.

8. Disclaimers

We do not warrant that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected. We are not responsible for any third-party services or content accessed through the Services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUXCASCADE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

10.1 Termination by You

You may terminate your account at any time through your account settings or by contacting us. Termination will be effective at the end of your current billing period.

10.2 Termination by Us

We may suspend or terminate your access to the Services at any time for any reason, including if we reasonably believe you have violated these Terms.

10.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. We may delete your account and Customer Data after a reasonable retention period. Sections of these Terms that by their nature should survive termination shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the modified Terms.
